Kompense is a product of Techno Believe Solutions Ltd (Company Number 10866509), a company registered in England and Wales with its registered office at 128 City Road, London, United Kingdom, EC1V 2NX.

Welcome to Kompense. These Terms of Service ("Terms") govern your access to and use of the Kompense platform, including our website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Account Terms

  • You must be at least 18 years old to use the Service.
  • You must provide accurate and complete registration information and keep your account information up to date.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • One person or legal entity may not maintain more than one free account.
  • You may not use the Service for any illegal or unauthorized purpose.

3. Service Description

Kompense provides an AI-powered competitive intelligence platform that helps businesses monitor competitors, track market changes, and generate actionable insights. The Service includes features such as competitor tracking, battlecard generation, pricing intelligence, and market analysis tools. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

4. Payment Terms

  • Paid plans are billed in advance on a monthly or annual basis, depending on your chosen billing cycle.
  • All fees are exclusive of taxes unless stated otherwise. You are responsible for all applicable taxes.
  • We may change our pricing with 30 days' advance notice. Price changes will apply at the start of your next billing cycle.
  • All payments are non-refundable except as expressly set forth in these Terms or as required by law.
  • If payment fails, we may suspend your access to the Service until the outstanding balance is resolved.

5. Free Trial

We may offer a free trial period for new users. At the end of the free trial, your account will automatically convert to a paid subscription unless you cancel before the trial ends. We will notify you before the trial period expires.

6. Cancellation and Termination

  • You may cancel your subscription at any time through your account settings or by contacting us at hello@kompense.com.
  • Cancellation takes effect at the end of your current billing period. You will continue to have access until then.
  • Upon cancellation, your data will be retained for 30 days, after which it will be permanently deleted.
  • We reserve the right to suspend or terminate your account if you violate these Terms, with or without notice.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Kompense and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without written permission.

You retain ownership of any data and content you upload to the Service. By uploading content, you grant us a limited license to use, process, and display that content solely for the purpose of providing the Service to you.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Kompense shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or similar issues transmitted through the Service by any third party

Our total liability for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. The competitive intelligence and market data provided through the Service is for informational purposes only and should not be the sole basis for business decisions.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of any material changes by posting the updated Terms on our website and notifying you via email. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
